  • We may receive information about you and your activities on and off the Site from third-party partners, such as information from a partner when we jointly offer services or from an advertiser about your experiences or interactions with them. OUR PURPOSE FOR COLLECTING INFORMATION

We use the information that we collect to conduct our business, deliver the Site, and to provide you with the best possible user experience. We may use the information in the following ways.

To Process Transactions:

We use third-party payment processors to process payments made to us. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, all such information is provided directly to our third-party processors and is governed by those third-party processors’ privacy policies. We only use payment processors who are PCI-compliant.

For Data Retention:

Subject to applicable law, we may retain your information for as long as your account is active or as needed to provide you products or services, comply with our legal obligations, resolve disputes and enforce our agreements. We may not remove your Personal Information when there is a legal storage requirement, such as accounting rules or when there are other legal grounds to keep the data, such as an ongoing contractual relationship.

We do not sell your personal information to third parties; however, we do share personal information with third parties for other purposes. We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We may share your personal information with the following categories of third parties:

  • Business Partners and Affiliated Companies. We disclose personal information and other data with select business partners and affiliated companies which provide goods, services and offers that enhance your experience with Company, or that we believe will be of interest to you.

When you enroll in those products or services, we disclose your personal information and other data to those third parties. Data shared in this way will be governed by the third party’s privacy policy and not this Privacy Policy.

Corporate Reorganization. We may disclose or transfer your personal information and other data to a third party in the event of any reorganization, merger, acquisition, sale, joint venture, assignment, transfer or other disposition of all or any portion of Company’s business, assets or stock (including any bankruptcy or similar proceedings).

We will use and disclose personal information as we believe to be necessary or appropriate: (a) to comply with applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including authorities outside your country of residence and to meet national security or law enforcement requirements; (d) to enforce our Terms and other agreements; (e) to protect our operations; (f) to protect the rights, privacy, safety or property of Company, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

AGGREGATE, DE-IDENTIFIED DATA

We also collect, use, and share aggregated and de-identified data such as statistical or demographic data for any purpose at our discretion. Aggregate and de-identified data could be derived from your personal information but will not directly or indirectly reveal your identity. If we combine or connect aggregate or de-identified data with your personal information so that it could be used to directly or indirectly identify you, we would treat such combined data as personal information, which will be used in accordance with this Privacy Policy.

In the preceding twelve (12) months, Company has disclosed the following categories of personal information for a business purpose:

YOUR RIGHTS AND CHOICES REGARDING YOUR PERSONAL INFORMATION

Right to Opt-Out

By using our Site, to the maximum extent permitted by applicable law, you expressly give your consent for the collection and use of your personal information in compliance with this Privacy Policy. This does not affect lawful processing under applicable laws based on other legal basis such as contractual obligation, compliance with applicable laws, and legitimate purposes. 

Company offers Site visitors a means to choose how we use the information provided. If you receive a marketing communication or promotion from us, you may opt-out of these communications at any time (i) by following the unsubscribe instructions included in the promotion (if sent by e-mail), or (ii) sending us an e-mail at the address noted in the Contact Information section above. Right to Access or Correct Personal Information

You have the right to access and correct your personal information. If you want to review or correct your personal information, you can login to the Site and visit your account profile page, or you may send us an e-mail at the address noted in the Contact Information section above.

CALIFORNIA RESIDENTS’ EXERCISING ACCESS, DATA PORTABILITY AND DELETION RIGHTS

California residents have the right to request that Company disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.

  • The specific pieces of personal information we collected about you (also called a data portability request).

Deletion Request Rights 

You have the right to request that Company delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your personal information rights. Unless permitted by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Our Policy on “Do Not Track” Signals and Third-Party Website Tracking under the California Online Privacy Protection Act (CalOPPA)

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

We do not engage in the collection of personal information over time across third-party websites, and we do not permit third parties to gather information passively on our website for behavioral advertising purposes.

Your California Privacy Rights

Under California law, a California resident with whom Company has an established relationship has the right to request certain information with respect to the types of personal information Company has shared with third parties for their direct marketing purposes (if any), and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. In response to a written request, Company is allowed to provide a cost-free means to opt-out of such sharing.

Since Company does not provide your personal information to third parties for their direct marketing purposes, it is not necessary for us to establish this procedure.

CHILDREN’S PRIVACY

Our Site and services are not intended for children under the age of 13. No one under age 13 years old may provide any personal information to or on the Site. We do not knowingly collect, maintain, or use personal information from children under the age of 13. If you are under 13 years old, do not use or provide any information on our Site, make any purchases through the Site, or provide any information about yourself to us, including your name, address, telephone number, or e-mail address. If we learn we have collected or received personal information from a child under 13 years old, we will promptly delete that information from our records.

INFORMATION SECURITY

Company will maintain appropriate technical and organizational security measures designed to protect your personal information from accidental loss, unauthorized use, alteration, or disclosure. Although we implement and maintain security measures that are appropriate for our business activities, please be aware that no security measures are perfect or impenetrable and any transmission of personal information is at your own risk. COOKIES AND TRACKING TECHNOLOGIES

Like most website operators, Company, its affiliated companies and business partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole (“Cookies”). You can control the use of Cookies at the individual browser level, but if you choose to disable Cookies, it may limit your use of certain features or functions on our Site. Unless you have adjusted your browser setting so that it will refuse Cookies, our system will issue Cookies when you direct your browser to our websites. Additionally, some Internet browsers have a "do not track" feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so we are currently not set up to respond to such signals.

We use session Cookies that expire at the end of a browser session (from when a user opens the browser window to when they exit the browser) and persistent Cookies which remain on your hard drive until you erase them or they expire. How long a persistent Cookie remains on your browser depends on how long the visited website has programmed the Cookie to last or they can be stored for longer.

We use Cookies for different purposes, including tracking your consent for various services, personalizing content, and targeting advertisements.

CHANGES TO THIS POLICY

Company reserves the right to modify this Privacy Policy at any time. It is our policy to post any changes we make to this Privacy Policy on this page at our Site and the changes will be effective upon Company’s publication of the updated Privacy Policy except as described below. WEBSITE LOCATION, TRANSFER AND PROCESSING
